THE IMPACT OF SOCIAL MEDIA ON CASES OF VIOLENCE IN HOUSEHOLD TO REALIZE JUSTICE CERTAINTY AND LEGAL EFFECTIVENESS (CASE STUDY OF LESTI KEJORA)

Blessed are the Indonesian people who already have a National Marriage Law, which in its nature is said to have accommodated the foundations and provided a legal basis for marriage which has been the basis for and applies to various different groups of Indonesian society. So the Indonesian nation already has a marriage law based on Pancasila and is still based on Bhinneka Tunggal Ika. Which means that even though in essence we already have a marriage law which is based on unity, its diversity still applies. Why is that, because the difference is still strong influence. Therefore, if people who are different meet in a (mixed) marriage bond, while one of the parties still maintains their grip, it will sometimes cause difficulties in settling it, which can even result in disrupting the harmony of household life.

Cases of domestic violence (KDRT) that occurred against Lesti Kejora can be resolved peacefully without going through criminal justice. Indeed, the nature of the Domestic Violence Law is that if there is an offense, even if there is regulation regarding the crime, it is only a complaint offense, that is, if a complaint is made, it is examined both at investigation, prosecution, and up to court, if it is not complained, it doesn't matter. . It was further explained that if there is an act of violence that results in someone being injured and unable to earn money, the police have the right to divert cases of domestic violence to general crimes. The criminal process must be transferred or diverted into general criminal acts. Later people beat people at will, even if it's his own wife, the articles in the Domestic Violence Law, namely Articles 44 and 45, must be translated that way, even though the complaint offense may have the report revoked. As long as the violence doesn't result in serious injuries and doesn't result in the victims being unable to earn their economic income, those are the limits.Indonesian and even foreign social media has been busy highlighting the KDR case that occurred against the popular dangdut singer Lesti Kejora who later withdrew reports regarding domestic violence against her husband.
