COMPARISON OF LAWS ON THE POSITION OF A CHILD IN THE WOMB AS AN HEIR ACCORDING TO THE CIVIL CODE AND ISLAMIC LAW

The purpose of this study is to examine and compare the legal status of children as heirs according to the Civil Code and Islamic law. The data collection process utilized primary legal sources, including the principles and provisions contained in documents such as the Civil Code, inheritance jurisprudence, and the Compilation of Islamic Law regarding inheritance. Additional information was obtained from law books, academic journals, scientific articles, legal dictionaries, and relevant encyclopedic references. This study reveals significant differences in the procedures for granting inheritance to unborn children
