PUTUSAN SENGKETA EKONOMI SYARIAH PENGADILAN NEGERI PASAMAN BARAT TENTANG PUTUSAN ARBITRASE BPSK KABUPATEN BATUBARA NOMOR 1409/ARB/BPSK-BB/IX/2016 (Studi Perkara Nomor 622 K/Pdt.Sus-BPSK/2017; 55/Pdt.Sus-BPSK/2016/PN Psb)
Abstract
Public awareness of the sharia economy, in line with the increasing number of people who become customers at Islamic banks, has implications for the possibility of disputes arising. One of them is the case of a sharia economic dispute, initially a Consumer Protection complaint was filed through the BPSK of Batu Bara Regency, which was then made by the BPSK Decision to appeal to the West Pasaman District Court with Decision Number 55/Pdt.Sus-BPSK/2016/PN.Psb by the Bank Syariah Mandiri Pasaman Barat, and an Cassation was carried out by Br. ADMI MARIATI to the Supreme Court of the Republic of Indonesia with Decision Number 622 K/Pdt.Sus-BPSK/2017. The purpose of this study is to determine the extent to which dispute resolution law enforcement is in accordance with the provisions and its application, seen from the contents of the decision number 622 K/Pdt.Sus-BPSK/2017; and Decision Number 55/Pdt.Sus-BPSK/2016/PN Psb. This research departs from the idea that the settlement of sharia economic disputes in this case Sharia Banking is based on the Qur'an and Hadith, even though the litigation settlement forum has been arranged through the Religious Courts, or the National Sharia Arbitration Board (Basyarnas) or Other Arbitration Institutions, or Banking Mediation but it turns out that when the Dispute is resolved through the Coal BPSK while the locus or object of the Dispute is in West Pasaman, West Sumatra, it turns out that there is still a limited understanding of the Sharia Banking business actors, we hope how to protect the Parties when the settlement is carried out, then it cannot be separated from the Law on Sharia Banking, along with agreements as the implementation of the provisions of the legislation itself.
