PENAFSIRAN ASAS KEPASTIAN HUKUM DAN KEKOSONGAN HUKUM DALAM KEPUTUSAN MAHKAMAH KONSTITUSI TERHADAP UNDANG-UNDANG NOMOR 11 TENTANG CIPTA KERJA (Kajian Keputusan Nomor 91/PUU-XVIII/2020)
Abstract
This scientific journal examines the Constitutional Court Decision Number 91/PUU-XVIII/2020 which is associated with Law Number 11 of 2020 concerning “Cipta Kerjaâ€. In its ruling, the Constitutional Court emphasized on guaranteeing the principle of legal certainty by giving the lawmakers the opportunity to make corrections within a maximum limit of 2 years. But on the other hand, in another point of ruling, the Constitutional Court has limited the applicability of the “Cipta Kerja†law through the prohibition of all strategic and broad-impact actions/policies. The research method used is normative juridical with a statutory approach, and a case approach in the form of court decisions that have permanent legal force. The results showed that the interpretation of the principle of legal certainty in the Constitutional Court Decision Number 91/PUU-XVIII/2020 which is associated with Law Number 11 of 2020 concerning “Cipta Kerja†which aims to facilitate, regulate efficiency and guarantee legal certainty in investment and business climate is not precisely because the points in the Constitutional Court's decision can cause legal problems in the future. The potential for neglecting the principle of legal certainty as a result of the Constitutional Court's ruling is due to the fact that in its decision the Court has limited the validity of the “Cipta Kerja†Law. Meanwhile, the old rules that have been replaced by the existence of this “Cipta Kerja†Act are also no longer valid. The condition of the old regulations has been revoked, while the replacement regulations cannot be implemented, this creates a legal vacuum which also means the neglect of legal certainty. Even though it is limited to a maximum period of 2 years, this is still a bad image for the fulfillment of the principle of legal certainty in Indonesia. The investment and business climate sector is a business that requires a long time assessment that can be more than 2 years.
