Abstract

The power of an independent judiciary institutionally and in the judicial process has been justified by legal provisions both national and international. With this judicial power, it is expected to produce quality judges' decisions so that they become an important reference in determining community law compliance. In essence, the judge in handing down a decision is influenced by 2 (two) streams, namely: (a) Conservative School, which is a judge's decision based solely on written legal provisions (laws and regulations), (b) Progressive School, which is a judge's decision that is not solely based on written legal provisions but the judge must also base on empirical knowledge and experience he has experienced. The purpose of this study is to analyze and examine how judges hand down a decision in law enforcement in Indonesia. This research uses qualitative writing methods normatively-juridically. This research identifies legal
principles and doctrines as a reference in responding to problems.
