Abstract

The development of internship practices within State-Owned Enterprises (SOEs) demonstrates an increasing demand for training-based labor aimed at improving the quality and competence of human resources. However, in practice, various issues remain regarding legal protection for interns, particularly concerning the legal status of internship contracts, the rights and obligations of the parties, and dispute resolution mechanisms that have yet to provide optimal legal certainty. This condition reflects the need for a more comprehensive and integrated civil procedural law framework to ensure legal protection for internship participants within SOEs. This study aims to analyze the forms of legal protection provided in internship contracts within SOEs and to examine the relevance of the Draft Bill on Civil Procedure Law (RUU Hukum Acara Perdata) in establishing a comprehensive national legal unification that guarantees legal certainty, justice, and legal benefits for parties involved in internship relationships. This research employs a normative legal research method using statutory and conceptual approaches. Legal materials are obtained from legislation, legal doctrines, and literature related to labor law and civil procedural law. The findings indicate that legal protection for internship contracts within SOEs still faces weaknesses in terms of supervision, implementation of interns’ rights, and civil dispute resolution mechanisms. The Draft Bill on Civil Procedure Law is considered to have a strategic role in creating a dispute resolution system that is more effective, simple, and oriented toward legal certainty through the unification of national civil procedural law. Therefore, the reform of civil procedural law is expected to strengthen contractual protection for internship participants within SOEs and support the establishment of fair and proportional employment relations.
