SANKSI PIDANA TERHADAP PELAKU PENIMBUNAN MASKER DAN PELIPATGANDAAN HARGA MASKER YANG MELONJAK TINGGI DI TENGAH PANDEMI COVID – 19

Abstract

ABSTRAK

Alat kesehatan berupa masker, hand sanitizer dan tabung oksigen sangat di perlukan sejak merebak nya panemi covid-19 pada awal tahun 2020. Masker hand sanitizer dan tabung oksigen tiba-tiba menjadi komoditas penting yang sangat dibutuhkan oleh mayarakat sekaligus menimbulkan peluang bisnis bagi kalangan enterprenuer yang melihat ada potesni keuntungan dan pengadaan kebutuhan masker bagi masyarakat. Tulisan ini berargumen bahwa dalam praktik penegakan hukum terhadap penimbun masker yang dilkukan oleh kepolisian atas kelangkaan dan harga masker yang tinggi dengan menerapkan pasal 29 UU Perdagangan,dianggap keliru dan tidak tepat karna masker tidak termsuk dalam barang pokok penting yang disebutkan secara limitative dalam peraturan presiden nomor 71 Tahun 2015 tentang penetapan dan penyimpanan barang kebutuhan pokok dan barang penting.

ABSTRACT

Medical devices in the form of masks, hand sanitizers and oxygen cylinders are urgently needed since the outbreak of the COVID-19 pandemic in early 2020. Hand sanitizer masks and oxygen cylinders suddenly became important commodities that were needed by the community as well as created business opportunities for entrepreneurs who see that there is potential for benefits and the procurement of masks for the community. This paper argues that in the practice of law enforcement against hoarders of masks carried out by the police for the scarcity and high price of masks by applying Article 29 of the Trade Law, it is considered wrong and inappropriate because masks are not included in the essential essential goods which are mentioned in a limitative manner in presidential regulation number 71 of 2015 concerning the determination and storage of basic necessities and essential goods
