Abstract

Neutrality of civil servants in political parties is a study of civil service law. The study of personnel law regulates civil servants who work in state administration. This is as stated by Utrech, who explained that administrative law examines the special legal relationships that are held to enable officials (amstragers) of the state administration to perform their special duties.PNS who becomes a candidate for DPR, Provincial DPRD, and Regency / City DPRD, his dismissal does not refer to a letter of resignation after being designated as a candidate by the General Election Commission (KPU), but his dismissal refers to the prohibition of PNS becoming a member and / or administrator of a political party. Therefore, PNS is prohibited from becoming a member and/or administrator of a political party, so PNS who becomes a member and/or administrator of a political party must resign in writing.
