Abstract

Legal development cannot be separated from the development of society, especially the development of science and technology. This study aims to examinethe development of the position and strength of electronic evidence in the civil evidence system in Indonesia. This research is normative juridical research using a statute, case, and conceptual approach. The study results show that electronic evidence is present along with the times in the era of information technology- baseddigitalization. His presence is also related to all aspects of life, including the world of law and justice. The validity, position, and strength of electronic evidence in civil cases is still under debate because no civil procedural law regulates electronic evidence. The role and strength of electronic evidence have been regulated in many laws and regulations in Indonesia. Still, in civil law, there are no provisions governing this electronic evidence. Broader problems also occur in civil matters, because nowadays, electronic transactions have become part of national and international commerce.
