ANALISIS YURIDIS TERHADAP PERCERAIAN AKIBAT KEKERASAN DALAM RUMAH TANGGA (KDRT) DI TINJAU DARI UU PERKAWINAN NO.1 TAHUN 1974

Abstract

Living a family life is certainly not detrimental and as smooth as imagined, there must be many ups and downs of problems that the family must face. Here understanding and a sense of family togetherness is needed so that later everything can be faced and in accordance with the expectations of each member of the family. In marriage, every couple is threatened with being able to build a harmonious, happy and loving family, but in fact many families are not harmonious, instead they feel depressed and sad because of domestic violence, both physical, psychological, sexual, emotional violence. , as well as family abandonment. With the reason of domestic violence, the wife filed a divorce suit to the religious court to break the marriage rope. Since the enactment of Law Number 7 of 1989 as amended by Law Number 3 of 2006 and the second amendment by Law Number 50 of 2009 concerning Religious Courts, the provisions regarding procedures for filing divorce and divorce for those who are Muslim conducted in the Religious Courts, have been regulated in this Law. This study aims to find out what are the causes of marital dissolution according to Law No. 1 of 1974 and how big the influence of divorce due to domestic violence (KDRT) is in terms of Marriage Law No. 1 of 1974. In this study the authors used a type of normative juridical research (normative legal research), namely legal research conducted by studying literature or secondary data. In accordance with the characteristics of the study, this study used the library research method (literary study). The outputs targeted in this study are mandatory outputs in the form of accredited national journals.
