Abstract

ABSTRACT: Investment is an investment activity that aims to gain future profits by providing capital (money). Along with technological developments, investment activities carried out by the community can be carried out online through online platforms. Attempts to promote and offer this type of illegal investment often involve influencers as a strategy to gain followers or potential investors. This study aims to analyze the role of influencers in promoting illegal investment. In general, influencers offer illegal investments by means of lures and even coercion so that potential investors want to invest the investment. Influencers take advantage of online media as a means for actors to find targets to be interested in making illegal investments as the term is known today. influencer criminal liability for illegal investments. The research method in this paper is normative through literature studies using a statutory approach. Investment activities can pose risks and losses for followers, namely the crime of illegal investment activities themselves. Meanwhile, as a result of illegal investment crimes, the perpetrators who are responsible can be subject to elements in Article 28 paragraph (1) in conjunction with Article 45 A paragraph (1) of the Electronic Information and Transaction Law.
