Abstract
The form of responsibility of the Land Deed Making Official in providing legal protection to the parties is the fulfillment of the rights and obligations of the seller and the buyer from the signing of the deed of sale and purchase before him (PPAT), the process of transfer of land rights is registered, until after receipt of the certificate of land rights as desired by the buyer, and in the future there will be no legal action and demands in any form and by any party as a result of a change in ownership of the rights land rights, so that the buyer feels secure in buying the land, just as the seller feels secure in selling his land rights. Secondly, the efforts made by the PPAT in providing legal protection to the parties in the sale and purchase legal action, i.e. the fulfillment of Article 1320 of the Civil Code relating to the legal requirements of sale and purchase, i.e. fulfilling its legal entitlement ; there is agreement; the ability to engage; certain things, and one thing lawful; the fulfillment of the requirements for the transfer of land rights and the control of BPHTB and PPh taxes, and because the transfer of land rights in Indonesia is based on customary law, the purchase and sale must also meet cash requirements, clear and real. Head of the BPN of the Republic of Indonesia n.05/SE/IV/2013 on the absence of the need to perform the pre-validation of BPHTB and PPh; so that the Land Office in carrying out land registration complies with the system operating procedure (SOP) or the operational guidelines that have been outlined by the National Land Agency (BPN), so that the process of transferring land rights can be implemented quickly and effectively; you don't get the impression of putting the applicant in difficulty, for example the problem of the name on the certificate not matching the name on the identity card.
