PENGAWASAN DAN PENEGAKAN HUKUM OLEH IMIGRASI TERHADAP PELANGGARAN KEIMIGRASIAN YANG DILAKUKAN OLEH WARGA NEGARA ASING DI INDONESIA BERDASARKAN UNDANG-UNDANG NOMOR 6 TAHUN 2011 TENTANG KEIMIGRASIAN

Abstract

Immigration is a matter of the traffic of people entering or leaving the territory of Indonesia and its supervision in the context of upholding state sovereignty. Immigration is a manifestation of implementing the enforcement of authority over Indonesian territory in the context of creating and maintaining order in the life of the nation and state in achieving a just and prosperous society based on Pancasila and the 1945 Constitution of the Republic of Indonesia. The current global dynamics are spurring an increase in the movement of the world community which results in various consequences, both those that provide benefits and those that cause harm to the interests and life of the nation and state of the Republic of Indonesia. In this case, the Directorate General of Immigration becomes the agency authorized to carry out tasks related to immigration. Furthermore, the provisions of Article 1 paragraph (6) of Law Number 6 of 2011 concerning Immigration state that: "The Directorate General of Immigration is an element implementing the duties and functions of the Ministry of Law and Human Rights in the field of Immigration.†In the context of carrying out immigration control, Immigration officials carry out the Immigration Intelligence function. The provisions of Article 74 of Law Number 6 of 2011 state that "To carry out the functions of Immigration Intelligence and immigration security and are authorized to obtain information from the public or government agencies; visit places or buildings where information is suspected to be found regarding the presence and activities of foreigners, carry out immigration intelligence operations; or safeguarding immigration data and information as well as safeguarding the implementation of immigration duties.â€
