ANALISIS YURIDIS MENGENAI HAK DAN KEWAJIBAN SUAMI ISTRI DITINJAU DARI UNDANG UNDANG NOMOR 1 TAHUN 1974 TENTANG PERKAWINAN

Abstract

The birth of the Marriage Law Number 1 of 1974 is the government's attempt to guarantee basic human rights in achieving happiness in a family. The rights and obligations of husband and wife are regulated in the Marriage Law articles 30 to 34 which are then divided into 3 namely the joint rights and obligations of husband and wife, wife's rights or husband's obligations, and husband's rights over wife. Rights and obligations between husband and wife are rights and obligations arising from the marriage between them. This study aims to determine the rights and obligations together as a husband and wife in a household so that a happy and prosperous family is formed based on the One God and the position of husband and wife in balanced rights and obligations. This research is based on the type of normative legal research. In normative research, a review of the law is carried out on the norms or rules that apply in society and become a reference for the behavior of everyone who regulates marriage, especially regarding the rights and obligations of husband and wife in Law Number 1 of 1974 concerning marriage. The outputs targeted in this research are mandatory outputs in the form of accredited national journals.
