Abstract

The purpose of this study is to find out the changes in the content regulating fixed -term employment contracts and the concept of protection for PKWT after the enactment of the law number 11 of 2020 on job creation which is being revised normatively. With Government Regulation no. 35 of 2021 on fixed-term employment contracts, outsourcing, working hours, employment relationships and rest periods and termination of the employment relationship (PP No. 35/2021 amendments, one of which concerns the provisions and implementation of the contract specific-term employment contracts (PKWT). Employment contracts are classified into two types, namely fixed-term employment contracts (PKWT) and permanent employment contracts (PKWTT). Changes to these provisions cannot be seen solely as changes for the benefit of certain actors, in this case the employers or employers and workers or workers. Instead, it has to be seen from a broader perspective, especially from the point of view of legal certainty, which is a indicator of ease of investment, which is the main driver for the enactment of the Job Creation Act and its derivative regulations.Through regulatory legal research which examines the content contained in the Job Creation Act and its implementing regulations, the research findings are expected to become input to the government so that it is able to formulate regulations that provide legal protection to employers and workers.
