PENYALAHGUNAAN NARKOTIKA DI KALANGAN MASYARAKAT DI TINJAU DARI UNDANG-UNDANG NO.35 TAHUN 2009 TENTANG NARKOTIKA

Abstract

Plans to revise Law no. 35 of 2009 concerning Narcotics is increasingly finding a bright spot. The new round of revision is entering the stage of submitting the President's Explanation on the Draft Law on the Second Amendment to Law No. 35 of 2009 concerning Narcotics. Representing the President of the Republic of Indonesia, Minister of Law and Human Rights of the Republic of Indonesia (Menkumham), Yasonna H. Laoly, conveyed the President's Explanation on the Draft Law concerning the Second Amendment to Law No. 35 of 2009 concerning Narcotics. In his quote, Yasonna H. Laoly, conveys Law No. 35 of 2009 in its implementation has not provided a clear concept of addicts, abusers and victims of drug abuse. Equal treatment between addicts, abusers and victims of drug abuse with dealers is considered to cause injustice in their handling. This rehabilitation approach is a form of restorative justice, namely resolving criminal cases by trying to recover victims.Narcotics are substances or drugs derived from plants or non-plants, both synthetic and semi-synthetic, which can cause a decrease or change in consciousness, loss of taste, reduce to eliminate pain and can cause dependence which are differentiated into Narcotics groups in the annex Law 35 of 2009 concerning Narcotics.The Narcotics Law aims to guarantee the availability of narcotics for the benefit of health services and the development of science and technology. Prevent, protect and save the Indonesian people from drug abuse, eradicate illicit drug trafficking and ensure the regulation of medical and social rehabilitation efforts for drug abuse and addicts.

This law establishes a national body, namely BNN. National Narcotics Agency as other laws in the regime at that time. Law Number 35 of 2009 concerning Narcotics was passed on October 12, 2009 in Jakarta by President Doctor Haji Susilo Bambang Yudhoyono. Law 35 of 2009 concerning Narcotics was promulgated by Menkumham Andi Mattalatta on October 12, 2009 in Jakarta. So that everyone knows, the Narcotics Law is placed in the State Gazette of the Republic of Indonesia of 2009 Number 143.
