Abstract

For almost the last four years, Indonesia has enacted Law No. 23 of 2004 concerning the Elimination of Domestic Violence or what is known as the Law on the Elimination of Domestic Violence (ratified 22 September 2004). This law prohibits acts of domestic violence against people within the scope of the household by means of physical, psychological, sexual violence or neglect in the household. The people within the scope of the household in question are husband, wife, children, and people who have family relations because of blood relations, marriage, breastfeeding, care, guardianship, living in the household and people who work to help and settle in the household the. Domestic violence or domestic violence is also known as wife beating, wife torture, spouse abuse, marital violence or family violence. Internal factors that cause Domestic Violence (KDRT) are often the nature of the perpetrator, poor economic conditions and communication. Other factors, mainly due to ethnic or cultural differences and environmental factors that support domestic violence. This increases cases of domestic violence in Indonesia. Efforts to protect the law for women who are victims of domestic violence in this country are regulated in Law no. 23 of 2004 concerning the Elimination of Domestic Violence. The Law on the Elimination of Domestic Violence (PKDRT) clearly stipulates the process that must be followed to deal with cases of domestic violence. Domestic violence is more common in women who are wives, while the perpetrators are mainly men. This is caused by internal factors including the personality of the perpetrator who tends to depend emotionally, economically, on third parties in the household. External factors include cultural/customary differences, differences in religion or beliefs of the husband and wife, and both are not well understood. In reality, cases of domestic violence that end in divorce can have a negative impact on both parties, especially children.
