Abstract

This study discusses the juridical review of legal protection against sexual violence against children in terms of Law No. 35 of 2014 amendments to Law No. 23 of 2002 concerning Children. This study aims to determine the juridical review of legal protection against sexual violence against children in terms of Law No. 35 of 2014 amendments to Law No. 23 of 2002 concerning Children. Data collected by means of non-participatory observation and interviews. The results of this study indicate that the existence of this law can emphasize the importance of imposing strict criminal sanctions and fines on perpetrators of crimes against children, providing a deterrent effect and restoring the physical, psychological and social conditions of children who experience violence, even if it is perpetrated by parents. In terms of violence against children, the sanctions given if the perpetrators themselves are parents are higher. A child according to Law Number 35 of 2014 is someone who is not yet 18 (eighteen) years old, including children who are still in the womb. Child protection is all activities to guarantee and protect children and their rights so that they can live, grow, develop and participate optimally in accordance with human dignity and values, and receive protection from violence and discrimination. The definition of protection in the field of law especially for children is contained in Article 1 number 2 of Law Number 23 of 2002 concerning Child Protection which states that protection is all activities to secure and protect children and their rights so that they can live, grow, develop and participate optimally in accordance with the dignity of humanity and receive protection from violence and discrimination. From this protection, protection activities are intended to be able to provide guarantees and protection for children including their rights so that they can grow and develop physically and mentally
