PERTANGGUNGJAWABAN PIDANA TERHADAP KORPORASI DALAM MELAKUKAN PEMBAKARAN HUTAN
Abstract
Forest fires can occur due to two factors, the first is due to accident, and the second is due to intentional involvement of several parties. From the incident of forest fires in Indonesia, the actors involved can be individuals or corporations. One way to stop these exploitative actions against forests is by imposing criminal responsibility on the perpetrators of forest fires, including corporations. This study examines the appropriate formula for imposing criminal penalties on corporations and how the judges face obstacles in imposing these penalties. This research uses normative research with prescriptive research characteristics, and the research data used is secondary data. This research shows that there are still different characteristics if a corporation is to be punished, because a corporation is a legal entity that does not have a body and soul like humans in general. With these obstacles in place, corporate criminal responsibility can be expanded in scope to the perpetrators who are responsible for forest fires in Indonesia.
