PROBLEMATIKA TRANSPORTASI DI ERA KEHADIRAN APLIKASI ONLINE DITINJAU DARI UNDANG-UNDANG NO. 8 TAHUN 1999 TENTANG PERLINDUNGAN KONSUMEN DAN PERATURAN MENTERI PERHUBUNGAN NO. 12 TAHUN 2019

Abstract

: Transportation is an activity of transporting/moving goods/people from another place to a different place. Transportation services that are increasingly qualified and have greater carrying capacity will make it easier for people to carry out their activities. Then with the emergence of online transportation it seems to help make it easier for people in transportation problems, where initially consumers had to go to the terminal or wait on the sidewalk to wait for public transportation. The existence of online transportation is not without competition with other transportation, but rather creates competition for other transportation, namely conventional transportation such as taxis, motorbike taxis, and also vehicles with yellow vehicle numbers which have been around for a long time as transportation services for consumers. The problem of this research is that the provisions governing that two-wheeled vehicles are not allowed to be used as public transportation. It is very clear that it can be said that companies providing online transportation application facilities that use two wheels as their transportation fleet have no existence in the eyes of the law. And consumer protection for users of online transportation services. This type of research uses normative law by using a descriptive form of analysis. The data source used in this research is secondary in the form of Law no. 8 of 1999 concerning Consumer Protection, and the Road Traffic and Transportation Act. The data collection method used is library research. Data analysis in this writing uses qualitative data. Protection for Go-Jek consumers is regulated in Article 16 of the Minister of Transportation Regulation Number 12 of 2019 concerning Safety Protection for Motorcycle Users Used for Public Interests.
