PEMBATALAN PERJANJIAN SEPIHAK SEBAGAI PERBUATAN MELAWAN HUKUM DITINJAU DARI PASAL 1365 KITAB UNDANG-UNDANG HUKUM PERDATA
Abstract
An agreement is an event where a person promises to another person or where the two of them bind themselves to an agreement made between the two. Unilateral cancellation of an agreement can be said to be an unlawful act because the act violates the law or law because in the agreement that has been made, both can cause legal consequences, because the cancellation is carried out unilaterally to one of the parties who is felt to be at a weak point with use their arbitrariness to cancel the agreement without any reason justified in law. Looking at how default can be used as an excuse in canceling an agreement, whether between default and unlawful acts have similarities because both are actions that can harm other people. In the research that raises the discussion of "Unilateral Cancellation of Agreements as an Unlawful Act in View of Article 1365 of the Civil Code" this is a normative juridical law study in the form of legislation or written law, in this case the author focuses on Article 1365 of the Civil Code.
