Education as one of the national objectives as contemplated in the preamble of the Constitution of Republic of Indonesia of 1945, which subsequently emphasized in Article 31 of the Constitution Republic of Indonesia of 1945, is an important part in improving the quality of human resources in Indonesia. Education is a conscious and planned effort to create an atmosphere of learning and the learning process in order that learners are actively developing the potential for him to have the spiritual strength of religious, self-control, personality, intelligence, noble character, and skills needed him, society, nation and state. In general level of education in Indonesia consists of early childhood education (ECD), primary education, secondary education, and higher education which are all systemic unity. ECD as part of the national education system, namely the overall educational components are interlinked in an integrated manner to achieve the goals of national education, addressed to the children from birth to the age of six years and held before the basic education level, is done through giving educational stimulus to help the growth and development physically and mentally in order that children have the readiness to enter further education. Implementation of ECD through formal channels in the form of Kindergarten (TK), Raudatul Athfal (RA), or other equivalent forms, through non-formal in the form of Playgroup (KB), Child Care (TPA), or other equivalent forms, and/or through informal channels in the form of family education or education held by the environment. Education in general—including ECD, in its implementation is very influenced by the system of government, it is as mentioned in Law Number 20 of 2003 concerning National Education System that puts the burden of the rights and obligations of the Central Government and Local Government as an executor in the achievement of national goals.The problem is, these laws as the operational base of national education, is intended only to students as old as seven to fifteen years. This means that not including ECD. This study is normative analytical, The data that have been collected, both primary legal materials, secondary law and tertiary legal materials processed and discussed using qualitative normative analysis.From this research it is known that the implementation of ECD in City of Tangerang Selatan in line with the theory of Law Welfare State and it is in respect of the existence of the main ideas and norms that indirectly becomes grand design by providing education: as a means to realize the intelligent society, modern and religious as mentioned in philosophically found in the Regulation of City of Tangerang Selatan Number 4 of 2010 concerning the Symbol of Region of TangerangSelatan City.
