UJI MATERIL MENGENAI UNDANG-UNDANG PEMILIHAN UMUM (Analisis Putusan No. 55/PUU-XVIII/2020)
Abstract
This research aims to find out what the judges of the Constitutional Court consider in deciding the application for Judicial Review Article 173 (paragraph (1) of Law Number 7 of 2017 concerning general elections against Article 28H paragraph (2) of the 1945 Constitution of the Republic of Indonesia. This research includes normative juridical research which is carried out through a statutory approach. The technique of collecting data is by means of library research, namely using literature (library), both in the form of books, the internet and other relevant references in order to answer the formulation of the problem. Based on the results of this study, namely, that the norms in Article 28H paragraph (2) of the 1945 Constitution in the constitutional norms referred to political parties are not legal subjects that deserve special treatment. The existence of Article 173 paragraph (1) of Law Number 7 of 2017 concerning General Elections is completely irrelevant to be tested using Article 28H paragraph (2) of the 1945 Constitution whose decision cannot be accepted in the decision of case no. 55/PUU-XVIII/2020 because there is no synchronous relationship regarding the arguments of the lawsuit (posita) with the petitum so that based on the Supreme Court Decision on December 16, 1970 No. 492K/Sip/1970 states that an unclear or imperfect claim can result in the claim not being accepted.
