PENAFSIRAN UNSUR IKTIKAD TIDAK BAIK DALAM PEMBATALAN MEREK DAGANG TERDAFTAR BERDASARKAN UNDANG UNDANG MEREK NOMOR 20 TAHUN 2016 TENTANG MEREK DAN INDIKASI GEOGRAFIS (Studi Kasus 575 K/Pdt.Sus-HAKI/2020)
Abstract
Brand is a mark which consists of pictures, names, words, alphabets, figures, color arrangement, of the combination of these elements which have distinctive power and are used in the activities of goods and services. For the recognition of a certain brand,the owner of the brand has to register it to the Directorate General of HAKI. This case began from the claim which was filed by Ruben Samuel Onso to PT Ayam Geprek Benny Sujono The plaintiff regarded that there was bad faith in registering a brand claimed bydefendant I, PT Ayam Geprek Benny Sujon. This case is inside Decision of the Supreme Court of the Republic of Indonesia Number 575k / Pdt.Sus.HKI / 2020, available In the case of dispute in the registration of the mark with the Plaintiff, it is considered that the mark used by Defendant 1 is the property of the Plaintiff. The research problem includes the existence of Brands on behalf of Ruben Samuel Onsu which basically have similarities with the brands owned by PT. Ayam Geprek Benny Sujono, this is evidence of a dispute over a registration mark between Ruben Samuel Onsu and PT. Chicken Geprek Benny Sujono.
