PERAN KEMENTERIAN KESEHATAN DALAM PENGENDALIAN RISIKO COVID-19 BAGI TENAGA KESEHATAN BERDASARKAN PERATURAN MENTERI KESEHATAN NOMOR 66 TAHUN 2016 TENTANG KESELAMATAN DAN KESEHATAN KERJA RUMAH SAKIT
Abstract
This thesis research aims to analyze the role of the Ministry of Health and find out the obstacles in controlling the risk of COVID-19 for health workers based on the Minister of Health Regulation Number 66 of 2016 concerning Hospital Occupational Safety and Health (HOHS). The method used in this thesis research is a type of normative and empirical legal research with a sociological legal approach that studies law in a social context, especially the role of the Ministry of Health in controlling the risk of COVID-19 for health workers. Primary data collection uses instruments through interviews with informants at the Ministry of Health and managers of the HOHS program as stakeholders in controlling the risk of COVID-19. Secondary data is obtained from laws and regulations and documents related to HOHS. The results of this study indicate that the role of the Ministry of Health has determined the accreditation of training curriculum standards in the field of HOHS, coordinated HOHS external assessments integrated with hospital accreditation, as well as fostering the implementation of HOHS, including advocacy activities, socialization, and technical guidance in stages to the Health Office. Provinces, Districts/Cities and Hospitals, HOHS training and Occupational Diseases, workshops, orientation and capacity building of HOHS human resources with adaptation to pandemic situations. However, for supervision, evaluation monitoring activities still need to be improved and sanctions have not been applied to hospitals that have not implemented HOHS. The obstacle is that it is difficult to identify where health workers are exposed to COVID-19 because the practice permit is more than one place and the application of health protocols, especially the use of Personal Protective Equipment (PPE) that is not fully compliant with the PPE level standard, there are still limited HR managing HOHS both in quality and quantity, and COVID-19 as a new disease is highly contagious and mutable which is still being researched. For this reason, it is necessary to provide administrative sanctions to hospitals that have not implemented HOHS, increase monitoring and evaluation of practice places and implementation of standard health worker protocols, guidance and supervision of hospitals that do not have OHS human resources, as well as socialization about controlling COVID-19 according to developments continuously.
