TINJAUAN YURIDIS TENTANG KEKUATAN HUKUM SERTIFIKAT TANAH PENGGANTI SEBAGAI BUKTI HAK ATAS KEBENDAAN DITINJAU DARI PASAL 32 AYAT (1) PERATURAN PEMERINTAH NO 24 TAHUN 1997 TENTANG PENDAFTARAN TANAH (Studi Kasus Di Kantor Badan Pertanahan Nasional Kota Depok)
Abstract
A land certificate is a document of proof of a person's ownership of a land or evidence for the holder of legal rights to the land. of course, therefore we must keep this important document with care and care, just as we treat our other securities. With the passage of time the ownership of land rights holders to land certificates, problems often occur regarding the certificates they have. Whereas land certificates are very important and are a strong evidence of ownership of land rights. Such problems are for example the destruction of land rights certificates caused by accidental damage due to natural disasters or damage due to paper that is eaten by age or the certificate is torn due to the carelessness of the holder, so that the land certificate cannot be used or read. In addition to the destruction of certificates, another problem that is very dangerous for land certificate holders is the loss of the certificate, whose whereabouts are not known, so that it is very detrimental to the holder of land rights. This study aims to identify and explain the legal force of replacement land certificates. The research method used in this paper is normative and empirical juridical legal research, which is a scientific research procedure to find the truth based on legal scientific logic and obtain sources from the interview process in the field. The results of the research are in Article 32 paragraph (1) of Government Regulation Number 24 of 1997 which contains: "a certificate is a letter of proof of rights that applies as a strong evidence tool regarding physical data and juridical data contained therein, as long as the physical data and juridical data are in accordance with the data contained in the letter of measurement and the land book concerned." Therefore, the legal force of a replacement land certificate due to loss or damage is as strong as the first land title certificate
