PENYELESAIAN SENGKETA DANA PENSIUN MELALUI BADAN MEDIASI DANA PENSIUN (BMDP) BERDASARKAN LEMBAGA ALTERNATIF PENYELESAIAN SENGKET DI SEKTOR JASA KEUANGAN
Abstract
Financial services are one of the sectors that play a major role in the economic development of a country. The Indonesian Financial Services Authority as an independent regulatory and supervisory agency in the financial services sector has one important task to provide protection to consumers in the financial services sector. himself (retired young). A person who retires is usually entitled to a pension or severance pay. If he gets a pension, he will remain in the pension fund until he dies. Pension Fund is a legal entity that manages and runs a program that promises pension benefits. The Pension Fund Mediation Agency is a body for resolving disputes in pension funds. As is known, there are two types of pension funds in Indonesia, namely the Financial Institution Pension Fund (DPLK) and the Employer Pension Fund (DPPK). Pension fund participants can use BMDP services if they want to resolve a dispute with the pension fund. If there is a dispute regarding pension funds, it must be resolved through the BMDP, one of the functions of which is to regulate procedures for handling complaints and resolving consumer disputes in a simple, fast, and affordable cost. As a follow-up, OJK issued POJK Number 61/POJK.07/2020 concerning Alternative Dispute Resolution Institutions in the Financial Services Sector. This study aims to find out how the Pension Fund Dispute Settlement Stage is through an Alternative Dispute Resolution Institution in the Financial Services Sector or the Pension Fund Mediation Agency (BMDP) and how the Effective Role of the Pension Fund Mediation Agency (BMDP) in Resolving Pension Fund Disputes. The research method used in this paper is normative juridical law research, which is a scientific research procedure to find the truth based on the logic of legal scholarship from the normative side. The results of the study state that: 1. Based on the regulatory concept, dispute resolution in the financial services sector arising from consumer complaints is required to be resolved internally at the relevant financial services institution, which is more of a negotiated settlement or settlement by deliberation to reach consensus. Furthermore, if an agreement on the settlement of the complaint is not reached, consumers and financial service institutions can resolve the dispute by way of settlement through LAPS in the financial services sector, namely the Pension Fund Mediation Board or through the courts. This shows that in the second stage (external settlement), the use of LAPS is still an option other than settlement through the courts. 2. The Pension Fund Mediation Agency has not been effective in carrying out its duties and functions. This situation is due to the obstacles faced, namely human resources and services as well as inadequate facilities and infrastructure and lack of socialization of BMDP to the community. Efforts made to overcome these obstacles are that OJK supervises activities, work plans, budgets, LAPS principles, dispute resolution reports, and reassesses LAPS which are included in the OJK LAPS list and BMDP continues to provide understanding to consumers or the public.
