Regulations Governing Criminal Provisions in the Substance of Local Regulations Following the Entry into Force of Law No. 1 of 2026 on Criminal Adjustments

Abstract

Criminal provisions are one of the permitted subjects of local regulations. In principle, such provisions are limited to imprisonment for a maximum of 6 (six) months or a fine of up to Rp50,000,000.00 (fifty million rupiah). However, following the enactment of Law No. 1 of 2026, the regulations regarding criminal provisions in the content of Regional Regulations have undergone changes. Therefore, this study aims to analyze the historical development of regulations concerning criminal provisions in the content of Regional Regulations, along with their evolution and adjustments to Regional Regulations following the enactment of Law No. 1 of 2026. This study is a legal study employing a legislative and conceptual approach. The results of this study indicate that the provisions regarding criminal penalties in the substance of local regulations, as set forth in Article 15 of Law No. 12 of 2011 and Article 238 paragraph (2) of Law No. 23 of 2014 in conjunction with Article 5 paragraph (2) of Minister of Home Affairs Regulation No. 80 of 2015 are limited to imprisonment for a maximum of 6 (six) months or a fine of up to Rp50,000,000.00 (fifty million rupiah). However, following the enactment of Law No. 1 of 2026, the criminal provisions that may be included in the substance of a Regional Regulation are limited to fines of Category III, namely up to Rp50,000,000.00 (fifty million rupiah). Regional Regulations may no longer contain criminal provisions in the form of imprisonment. Consequently, Local Regulations that still contain provisions for imprisonment must be repealed, and those that still contain fines exceeding Category II that is, up to Rp10,000,000.00 (ten million rupiah) must be amended to a maximum of Category III.
