LEGAL POLITICS OF DETERMINING THE LAW ON THE CAPITAL OF THE INDONESIAN NATION, REVIEWED FROM THE PRINCIPLES OF FORMING GOOD LEGISLATION

Abstract

Since the Dutch colonization, Jakarta has been the Indonesian capital city. Thus, Jakarta has become the center of government and business in Indonesia, and many people live in the capital city. Eventually, Jakarta was considered as a "too old" metropolitan city, and an IKN was needed to replace it. With the help of the IKN Law, the government was able to start building a new metropolitan city. This article explains how the IKN Law serves as the legal basis for the new capital city, but there are formal and material errors in its formulation and ratification. Secondary sources—articles in journals, books, and news—are the subject of this study. The research method used is the statutory methodology, namely by conducting research through book materials related to the topic of the article. It is the conclusion of this article that because the IKN Law was passed too quickly, it is considered to have weaknesses and may violate the 1945 Constitution and the principles of the formation of laws and regulations.
