Abstract

ABSTRACT

This study discusses the dynamics of decision-making in international organizations through the analysis of the relationship between normative authority frameworks and their empirical practices. The research focuses on two main forms of competence, namely the powers explicitly stated in the organization's charter and the implied powers that arise from operational necessities to achieve institutional goals. The distinction between das sollen and das sein is used as an analytical framework to assess tensions between legal norms and organizational practices on the ground. Through case studies of WHO, IMF, and ASEAN, this study shows how international organizations often have to act beyond their textual mandates to respond to rapidly evolving global issues, while also highlighting potential conflicts regarding the limits of authority and institutional legitimacy. The research findings emphasize the importance of balancing organizational flexibility with compliance with the founding charter to ensure that actions remain effective and legal. This study contributes to both conceptual and practical understanding of the development of the authority of international organizations amid contemporary global dynamics.

ABSTRAK

Penelitian ini membahas dinamika pembuatan keputusan dalam organisasi internasional melalui analisis hubungan antara kerangka kewenangan normatif dan praktik empirisnya. Penelitian ini berfokus pada dua bentuk kompetensi utama, yaitu kekuasaan yang dinyatakan secara eksplisit dalam piagam organisasi dan kekuasaan yang tersirat yang muncul dari kebutuhan operasional untuk mencapai tujuan institusional. Perbedaan antara das sollen dan das sein digunakan sebagai kerangka analisis untuk menilai ketegangan antara norma hukum dan praktik organisasi di lapangan. Melalui studi kasus WHO, IMF, dan ASEAN, penelitian ini menunjukkan bagaimana organisasi internasional seringkali harus bertindak di luar mandat tekstual mereka untuk merespons isu global yang berkembang pesat, sambil juga menyoroti potensi konflik mengenai batas-batas otoritas dan legitimasi institusional. Temuan penelitian menekankan pentingnya menyeimbangkan fleksibilitas organisasi dengan kepatuhan terhadap piagam pendiri untuk memastikan bahwa tindakan tetap efektif dan legal. Penelitian ini memberikan kontribusi pada pemahaman konseptual maupun praktis mengenai perkembangan wewenang organisasi internasional di tengah dinamika global kontemporer.
