Analisis Kritis Ilmu Hukum Plural Terhadap Metode Hukum Komparatif dan Komparasi Hukum

Dalam jurnal ini akan membedah permasalahan (1) Apakah urgensi penelitian perbandingan hukum penting dalam kajian pluralisme hukum? (2) Apakah secara kritis metode perbandingan hukum berperan dalam upaya mewujudkan pluralisme hukum? Tipe penelitian dalam melakukan penyusunan jurnal dilakukan penelitian/pengkajian terhadap permasalahan metode hukum komparatif dan evaluasi komparatif terhadap solusi yang diperbandingkan metode perbandingan dalam ilmu hukum plural, dengan menggunakan metode pendekatan yuridis normatif melalui studi kepustakaan dengan menelaah data sekunder, berupa peraturan perundang-undangan atau dokumen hukum lainnya, dan hasil penelitian, pengkajian, serta referensi lainnya yang berkaitan dengan permasalahan. Dalam studi komparatif seharusnya menerapkan landasan historis yang kuat dalam konteks sosio-kultural sistem hukum yang dikaji, perbandingan hukum seharusnya mencermati pemahaman mereka sendiri tentang hukum dan memberikan perhatian kepada pengembangan hukum. dalam ruang plural tersebut dapat dipahami bahwa dua tatanan hukum yang berbeda, dianalisis dari sudut pandang horizontal atau vertikal, muncul sebagai tatanan biner di mana perbedaan tersebut hidup secara berdampingan dengan seperangkat prinsip umum. Koeksistensi harus secara substansial mengecualikan posisi kaku sentralisme hukum dan gagasan monopoli negara atas produksi norma-norma yang valid.
