Politik Hukum Pembentukan Rancangan Undang-undang Cipta Kerja (Studi Klaster Ketenagakerjaan)

Pemerintah merupakan pihak pengusul Rancangan Undang-Undang Tentang Cipta Kerja yang saat ini tengah dibahas oleh DPR RI. Pembahasan mengenai Rancangan Undang-Undang Tentang Cipta Kerja menuai banyak protes dari berbagai pihak, termasuk diantaranya Pekerja/Buruh yang melakukan penolakan secara terang-terangan didasarkan pada tidak diikutkannya Pekerja/ Buruh dalam proses pembahasannya dan substansi Klaster Ketenagakerjaan pula mengubah banyak pasal yang sifatnya perlindungan dari Negara kepada pekerja dalam Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan. Penelitian adalah Penelitian Hukum yang menggunakan pendekatan historical dan konseptual. Kesimpulan dari penelitan ini yaitu Konstitusi Negara Republik Indonesia yang telah secara jelas mengamanatkan perlindungan kepada pekerja yang sama sekali tidak tergambarkan baik dalam Nasakah Akademik maupun Rancangan Undang-Undang Tentang Cipta Kerja.
